The jobpassin platform, operated by our company, offers a range of services related to job seeking. These services include, but are not limited to, the following (depending on the package you choose to purchase or acquire): (i) matching job seekers' CV/resume with open positions in specific territories that we, at our discretion, deem suitable destinations for expat workers. Through our automated aggregation tools, we aim to update you on job opportunities publicly advertised by third-party employers or agencies ("Offerors") that we believe align with your qualifications or preferences ("Job Opportunities"). This matching process takes place on our platform. (ii) Registration for certain courses designed to provide you with guidance, tools, or additional qualifications relevant to job interviews and job opportunities. These courses are offered and provided by third parties ("Third Party Services"). Please note that participation in these Third Party Services may be subject to additional terms, agreements, and policies established by the respective third parties. Furthermore, the content and type of certification issued under these Third Party Services are at the discretion of the third-party providers. (iii) CV editing services. Collectively, these services are referred to as the "Services."
To access and utilize our Services, you will need to create an account ("Account") on our Website. During the sign-up process, you will be asked to provide your CV/resume and additional information pertaining to your desired job position. The information you provide during registration and in connection with your Account will be processed in accordance with our Privacy Policy. We strongly recommend that you carefully review the Privacy Policy to gain a better understanding of how we handle and process your Personal Data (as defined in the Privacy Policy). By signing up, you represent and warrant that the information you provide is accurate and complete. In the event of any untrue or inaccurate information, the Company reserves the right to suspend or terminate your Account, at its sole discretion and without notice or liability. During registration, you will select a personal and exclusive username and password to access your Account, or such credentials will be provided to you by the Company. You are solely responsible for maintaining the confidentiality of your password and username and for all activities that occur under your Account, including those carried out on your behalf. Instead, our Company employs tools to match your CV with relevant Job Opportunities made public by third-party Offerors, with the goal of exposing job seekers to potential opportunities. The Company is not responsible for the content and requirements of Job Opportunities, as these are determined solely by the Offerors. It is important to note that not all Job Opportunities guarantee employer sponsorship for foreign applicants. The decision to offer sponsorship to a foreign employee is entirely at the discretion of the employer. Additionally, the Company is not responsible for any interview requests or employment offers made, issues arising from acceptance or denial of employment, or any rights you may have under applicable employment, equality, or discrimination legislation. These matters fall under the sole responsibility of the Offerors.
Our Website also provides a wealth of information and resources related to our business operations and Services. This includes various forms of content such as articles, images, text, logos, button icons, links, and other features collectively referred to as "Content." 3. Fees and Payments
As the Company operates as a platform and does not function as an employment or recruitment agency, the fees charged are solely for the use of the Platform and Services provided, based on the chosen scope of services, features, and packages ("Packages"), or other standalone products. The price and features of each Package will be as communicated by us through our correspondence with you or other documents provided ("Fees").
All fees and charges must be paid using a valid credit or charge card or other accepted forms of payment as specified on the Website ("Paid Products"). You acknowledge that the Company may, at its sole discretion and without prior notice, impose payment requirements for the use of any or all of its Services, modify or change the Paid Products, convert unpaid products into Paid Products, or vice versa, either for all users, a specific group of users, or your specific use. If you have purchased Paid Products on a standalone basis and not as part of a Package, you have the right to a fourteen (14) day Cooling-Off Period as mandated by applicable consumer law ("Cooling Off Period"). The Cooling Off Period begins from the date of purchase of the Paid Product. However, if you utilize the Services in any manner, you agree that you forfeit the right to cancel during the Cooling Off Period and are not entitled to a refund. It is important to note that if you have purchased a Package, the Cooling Off Period does not apply.
The Company reserves the right to utilize third-party electronic payment processors and/or financial institutions to process payments made by you in connection with your use of the Services.
In the event of suspected or fraudulent payment activities, such as the use of stolen credit cards or any other fraudulent actions (including chargebacks or payment reversals), the Company reserves the right to block your Account and reverse any refunds issued, if applicable. The Company may also notify relevant authorities or entities, including credit reference agencies, of any payment fraud or unlawful activities and may employ collection services to recover payments.

If you unilaterally resolve the problem by canceling the transaction through your bank or credit card company, we reserve the right to contact the bank and submit a re-presentment letter to reclaim the funds. The Company may, at its sole discretion, cease providing Services to certain users or users who pay with specific credit cards.
4. No Guarantee & Disclaimer of Liabilities
The Company does not provide any guarantees or warranties regarding the effectiveness or timeliness of the Services in meeting your employment objectives. We do not guarantee that all Job Opportunities will meet your specific requirements, nor do we guarantee that the Services will result in Job Seekers being hired, receiving interview invitations, positions being filled, or employees being retained. The Company is not responsible or liable for any business, employment, hiring, or salary decisions made for any reason.
The JobPassIn Websites, Platform Services, and Content are provided on an "as is" basis, without any warranties whatsoever. The Company, its owners, subsidiaries, divisions, affiliates, officers, directors, employees, agents, representatives, suppliers, or licensors do not make any expressed, implied, or statutory warranties, claims, or representations regarding the JobPassIn Websites, Platform Services, and Content. This includes, but is not limited to, warranties of quality, performance, non-infringement, merchantability, or fitness for a particular purpose. The Company and its associated parties also do not guarantee that the JobPassIn Websites, Platform Services, and Content will always be available, accessible, uninterrupted, timely, secure, accurate, reliable, complete, or error-free. We do not warrant the success or acceptance of a visa through any of the JobPassIn Websites or Services. Any use of our Websites, Services, and Content is solely at your own responsibility and risk.

This includes, but is not limited to, material that encourages conduct that would constitute a criminal offense, violates the rights of others, or otherwise violates any applicable local, state, national, or international law.
6. Intellectual Property
The Websites and all of their Services, including but not limited to logos, text graphics, buttons, icons, images, videos, sounds, names, 'look and feel', source code, and any other intellectual property contained within them, whether copyrighted, patented, trademarked, or otherwise protected, are considered trade secrets, proprietary information, and intellectual property owned by the Company. If, despite the other provisions of this agreement, the Company is found to be liable to you for any damages or loss arising from the use of the websites or services, the Company's liability shall not exceed the lesser of (a) the fees paid by you for the paid product, or (b) $50.00 (United States Dollar). Civ. Code §§ 1798.100 - 1798.199)) or any subsequent amendments or replacements ("Data Protection Laws"), you hereby assure that you will access and process the Personal Data solely for the purpose of evaluating the suitability of Job Seekers for your requirements and proposing positions to Job Seekers. This usage must be in compliance with the provisions of Data Protection Laws. You further confirm that you have implemented and maintain appropriate physical, technical, and organizational measures to ensure the lawful processing of Personal Data, as required by Data Protection Laws, and to protect against unauthorized, unlawful, or accidental processing, access, disclosure, loss, alteration, or destruction of such data.
11. Termination
The Company reserves the right to limit, suspend, or terminate your use of the Services, including Paid Products, and delete your Account at any time and without prior notice, with or without cause. Such action may be taken with immediate effect and without recourse. In accordance with applicable laws, if applicable, we will provide a refund for any Paid Products. The Company shall not be held liable for any damages resulting from or related to the termination, suspension, or restriction, regardless of the reason.

12. Governing Law
These Terms of Service shall be governed by and interpreted in accordance with the laws of England and Wales. Any cause of action you may have concerning the Websites and Services is limited to a period of one (1) year from the occurrence of the incident and will be permanently barred thereafter.
